শনিবার সুপ্রিম কোর্টের কনফারেন্স কক্ষে ‘শিশু আইন-২০১৩’ নিয়ে বিভাগীয় পরামর্শ সভায় তিনি এমন মন্তব্য করেন। জাতিসংঘের শিশু তহবিল (ইউনিসেফ বাংলাদেশ) এবং সুপ্রিম কোর্ট স্পেশাল কমিটি অন চাইল্ড রাইটস যৌথভাবে এ অনুষ্ঠানের আয়োজন করে।
শিশু-কিশোরদের অপরাধের বিচারের জন্য শিশু আদালত প্রতিষ্ঠায় সরকারের সদিচ্ছার অভাব রয়েছে বলেও মন্তব্য করেন তিনি।
ইমান আলী বলেন, ২০১৭ সালের মে মাসে আইনমন্ত্রী পৃথক শিশু আদালত প্রতিষ্ঠার কথা বলেছিলেন। কিন্তু দুই বছর কেটে গেলেও সেটি বাস্তবায়ন হয়নি।
বিশ্বের বিভিন্ন গরিব রাষ্ট্রগুলোতেও শিশুদের জন্য আলাদা আদালত রয়েছে। কিন্তু আমাদের দেশে এখনও এ ব্যবস্থা গড়ে না ওঠায় আক্ষেপ প্রকাশ করেন তিনি।
আপিল বিভাগের জ্যেষ্ঠ এ বিচারপতি বলেন, শিশু-কিশোরদের অপরাধের বিচারের জন্য আলাদা ‘শিশু আদালত’ হওয়া উচিত। কারণ, শিশুদের বিচার হবে সংশোধনের উদ্দেশে। শাস্তি দেয়ার উদ্দেশে নয়। শিশু আর প্রাপ্ত বয়স্ক অপরাধীর বিচার এক রকম নয়। প্রাপ্ত বয়সের অপরাধীর ক্ষেত্রে শাস্তি দেয়াই থাকে উদ্দেশ। কিন্তু শিশুদের ক্ষেত্রে সেটি নয়।
আইনেই বলা আছে শিশু অপরাধীর বিচার তাড়াতাড়ি করতে হবে। কেননা তাদের ভবিষ্যত সামনে। তাকে ভালো হওয়ার সুযোগ দিতে হবে। শিশুদের জন্য পৃথক আদালত হওয়া উচিত। যেখানে শুধুমাত্র শিশুদের অপরাধের বিচার কাজ চলবে। অগ্রাধিকার ভিত্তিতে এসব শিশু আদালত স্থাপনের বিষয়েও মন্তব্য করেন বিচারপতি মোহাম্মদ ইমান আলী।
অনুষ্ঠানে উপস্থিত ছিলেন সুপ্রিম কোর্টের হাইকোর্ট বিভাগের বিচারপতি শেখ হাসান আরিফ, বিচারপতি নাইমা হায়দার, খুলনা, বরিশাল ও সিলেট বিভাগের নারী ও শিশু নির্যাতন দমন ট্রাইব্যুনালের বিচারক ও পাবলিক প্রসিকিউটর, চিফ মেট্রোপলিটন ম্যাজিস্ট্রেট এবং চিফ জুডিসিয়াল ম্যাজিস্ট্রেটরা।
