রাষ্ট্রপক্ষে সংশ্লিষ্ট আদালতের সহকারী পাবলিক প্রসিকিউটর মোহাম্মাদ সালাহউদ্দিন হাওলাদার এবং আসামিপক্ষে আইনজীবী শাহিনুর ইসলাম যুক্তিতর্ক উপস্থাপন করেন।
মামলাটি ঢাকার এক নম্বর মহানগর বিশেষ ট্রাইব্যুনালের বিচারক কে এম ইমরুল কায়েশের আদালতে বিচারাধীন ছিল। গত ৬ সেপ্টেম্বর মামলার অবশিষ্ট অংশ বিচারের জন্য সংশ্লিষ্ট আদালতে পাঠানো হয়।
গত ৫ সেপ্টেম্বর মামলাটিতে সাক্ষ্যগ্রহণ শেষ হয়। মামলাটিতে ১৩ জন সাক্ষীর মধ্যে ১৩ জনেরই সাক্ষ্যগ্রহণ করেন আদালত। গত ৯ সেপ্টেম্বর আত্মপক্ষ শুনানিতে নিজেকে নির্দোষ দাবি করে ন্যায়বিচার চান আব্দুল মালেক।
গত ১১ জানুয়ারি মামলার তদন্ত কর্মকর্তা র্যাব-১ এর এসআই মেহেদী হাসান চৌধুরী মালেকের বিরুদ্ধে চার্জশিট দাখিল করেন। এরপর গত ১১ মার্চ আব্দুল মালেকের বিরুদ্ধে অভিযোগ গঠনের মাধ্যমে বিচার শুরুর আদেশ দেন।
অবৈধ অস্ত্র, জাল নোট ব্যবসা ও চাঁদাবাজিসহ বিভিন্ন সন্ত্রাসী কর্মকাণ্ডের সঙ্গে জড়িত থাকার অভিযোগে গত বছর ২০ সেপ্টেম্বর ভোরে রাজধানীর তুরাগ এলাকা থেকে গাড়িচালক আবদুল মালেক ওরফে ড্রাইভার মালেককে গ্রেপ্তার করে র্যাব-১। এ সময় তার কাছ থেকে একটি বিদেশি পিস্তল, পাঁচ রাউন্ড গুলি, দেড় লাখ বাংলাদেশি জাল নোট, একটি ল্যাপটপ ও মোবাইল ফোন উদ্ধার করা হয়।
এ ঘটনায় র্যাব-১ এর পরিদর্শক (শহর ও যান) আলমগীর হোসেন বাদী হয়ে তুরাগ থানায় অস্ত্র ও বিশেষ ক্ষমতা আইনে দুটি মামলা দায়ের করেন।
