দুই শিশু জেসমিন মালিকা ও লাইলা লিনা বাংলাদেশি বাবা ইমরান শরীফের কাছে থাকবে নাকি জাপানি মা নাকানো এরিকোর কাছে থাকবে? এই প্রশ্নের উত্তর মিলবে আজ। এ বিষয়ে সিদ্ধান্ত দেবেন হাইকোর্ট। বৃহস্পতিবার (১৬ সেপ্টেম্বর) বিচারপতি এম ইনায়েতুর রহিম ও বিচারপতি মো. মোস্তাফিজুর রহমানের হাইকোর্ট বেঞ্চ এ বিষয়ে আদেশ দেবেন। মামলাটি আদেশের জন্য কার্যতালিকায় ০২ নম্বর ক্রমিকে রাখা হয়েছে বলে জানা গেছে।
এর আগে গত ৩১ আগস্ট হাইকোর্ট আদেশ দেন বাবা-মাসহ রাজধানীর গুলশানের চার কক্ষবিশিষ্ট একটি বাসায় থাকবে জাপানি দুই শিশু জেসমিন মালিকা ও লাইলা লিনা। সেখানে তারা আপাতত ১৫ দিন থাকবে। ফ্লাটের ভাড়া উভয়পক্ষ বহন করবে।
সমাজসেবা অধিদপ্তরের ঢাকার ডেপুটি ডিরেক্টর তাদের তত্ত্বাবধান করবেন। প্রয়োজনে এ কর্মকর্তা ওই ফ্ল্যাটে রাত্রিযাপন করতে পারবেন। গুলশানের বাসায় থাকাকালীন তাদের নিরাপত্তা নিশ্চিত করতে ঢাকা মহানগর পুলিশ ও পুলিশের অপরাধ তদন্ত বিভাগকে (সিআইডি) বলা হয়। ১৬ সেপ্টেম্বর এই মামলার পরবর্তী আদেশের জন্য রাখা হয়। বিচারপতি এম ইনায়েতুর রহিম ও বিচারপতি মো. মোস্তাফিজুর রহমানের হাইকোর্ট বেঞ্চ এ আদেশ দেন। দুই শিশু ও তাদের বাবা-মায়ের মতামত নেওয়ার পর আদালত এই আদেশ দিয়েছেন। যদিও একই বাসায় শিশুদের বাবার রাত্রিযাপনে আপত্তি জানিয়েছিলেন শিশুদের মায়ের পক্ষের আইনজীবী। আদালত বলেছেন, আমরা চাই শিশুরা পারিবারিক পরিবেশে থাকুক।
আদালতে শিশুদের জাপানি মায়ের পক্ষে শুনানি করেন অ্যাডভোকেট মোহাম্মদ শিশির মনির। শিশুদের বাংলাদেশি বাবার পক্ষে শুনানি করেন অ্যাডভোকেট ফাওজিয়া করিম ফিরোজ। তাকে সহযোগিতা করেন ব্যারিস্টার মারুফুল আলম ও ব্যারিস্টার ফাইজা মেহরিন। এর আগে ওই দিন দুপুরে দুই জাপানি শিশু জেসমিন মালিকা ও লাইলা লিনা বাবার কাছে নাকি মায়ের কাছে থাকতে চান- এ বিষয়ে শিশুদের সঙ্গে একান্তে কথা বলেন হাইকোর্ট। বিচারপতিদের খাস কামরায় প্রায় আধ ঘণ্টা শিশুদের সঙ্গে কথা বলেন আদালত।
পরবর্তীতে নাকানো এরিকোর আবেদনের পরিপ্রেক্ষিতে গত ৮ সেপ্টেস্বর হাইকোর্ট আদেশ দেন দুই শিশু জেসমিন মালিকা ও লাইলা লিনাকে নিয়ে বেড়ানো বা মার্কেটে যাওয়ার জন্য বাইরে যেতে পারবেন জাপানি মা চিকিৎসক নাকানো এরিকো। বাংলাদেশি বাবা ইমরান শরীফও সন্তানদের নিয়ে বাইরে ঘুরতে যেতে পারবেন। এছাড়া ৯, ১১, ১৩ ও ১৫ সেপ্টেম্বর শিশুদের সঙ্গে রাতে থাকবেন মা। বাকি দিনগুলোতে বাবা-মা উভয়ই আগের নির্দেশ অনুযায়ী শিশুদের সঙ্গে থাকবেন। আজ পরবর্তী আদেশের জন্য রাখা হয়।
এর আগে, দুই মেয়ে জেসমিন মালিকা ও লাইলা লিনাকে আদালতে হাজির করার নির্দেশনা চেয়ে গত ১৯ আগস্ট হাইকোর্টে হেবিয়াস কর্পাস রিট করেন জাপানি চিকিৎসক নাকানো এরিকো (৪৬)। রিটে মেয়েদের নিজের জিম্মায় নেওয়ার নির্দেশনা চান ওই নারী।
ওই দিন জাপানি দুই শিশু ও তাদের বাবা শরীফ ইমরানকে এক মাসের জন্য দেশত্যাগে নিষেধাজ্ঞা দেন হাইকোর্ট। একইসঙ্গে দুই শিশুকে ৩১ আগস্ট আদালতে হাজির করার নির্দেশ দেন। সঙ্গে তাদের বাবা ও ফুফুকে নিয়ে আসতে বলা হয়। রাজধানীর গুলশান ও আদাবর থানার ওসিকে এই নির্দেশ বাস্তবায়ন করতে বলা হয়।
কিন্তু এর মধ্যেই ২২ আগস্ট ১০ ও ১১ বছর বয়সী মেয়ে দুটিকে হেফাজতে নেয় পুলিশের অপরাধ তদন্ত বিভাগ (সিআইডি)। এ বিষয়টি ২৩ আগস্ট হাইকোর্টের নজরে আনেন তাদের বাবার আইনজীবী ফাওজিয়া করিম।
আদালত দুই শিশুকে ৩১ আগস্ট পর্যন্ত তেজগাঁওয়ের ভিকটিম সাপোর্ট সেন্টারে উন্নত পরিবেশে রাখার নির্দেশ দেন। এ সময়ে প্রতিদিন সকাল ৮টা থেকে দুপুর ১টা পর্যন্ত জাপানি মা ও বিকেল ৩টা থেকে রাত ৮টা পর্যন্ত বাংলাদেশি বাবা শিশুদের সঙ্গে সময় কাটাতে পারবেন বলে নির্দেশ দেওয়া হয়।
একইসঙ্গে আদালত ওইদিন উভয়পক্ষের আইনজীবীদের ৩১ আগস্টের মধ্যে বিষয়টি সমাধান করতে ভূমিকা রাখতে বলেছিলেন। তবে ৩০ আগস্ট পর্যন্ত আইনজীবীদের উপস্থিতিতে কয়েক দফা বৈঠক করেও দুই পক্ষ কোনো সমঝোতায় আসতে পারেনি।
জানা গেছে, ২০০৮ সালে জাপানি চিকিৎসক নাকানো এরিকো ও বাংলাদেশি-আমেরিকান নাগরিক শরীফ ইমরান (৫৮) জাপানি আইন অনুযায়ী বিয়ে সেরে টোকিওতে বসবাস শুরু করেন। তাদের ১২ বছরের সংসারে তিন কন্যা সন্তান জন্ম নেয়। তারা তিনজনই টোকিওর চফো সিটিতে অবস্থিত আমেরিকান স্কুল ইন জাপানের শিক্ষার্থী ছিলেন।
২০২১ সালের ১৮ জানুয়ারি শরীফ ইমরান-এরিকোর বিবাহ বিচ্ছেদ হয়। ২১ জানুয়ারি ইমরান আমেরিকান স্কুল ইন জাপান কর্তৃপক্ষের কাছে তার মেয়ে জেসমিন মালিকাকে নিয়ে যাওয়ার আবেদন করেন। কিন্তু এতে এরিকোর সম্মতি না থাকায় স্কুল কর্তৃপক্ষ ইমরানের প্রস্তাব প্রত্যাখ্যান করে। এরপর এক দিন জেসমিন মালিকা ও লাইলা লিনা স্কুল বাসে বাড়ি ফেরার পথে বাসস্টপ থেকে ইমরান তাদের অন্য একটি ভাড়া বাসায় নিয়ে যান।
গত ২৫ জানুয়ারি শরীফ ইমরান তার আইনজীবীর মাধ্যমে এরিকোর কাছ থেকে মেয়েদের পাসপোর্ট হস্তান্তরের আবেদন করেন। কিন্তু এরিকো ওই আবেদন প্রত্যাখ্যান করে মেয়েদের নিজ জিম্মায় পেতে আদেশ চেয়ে গত ২৮ জানুয়ারি টোকিওর পারিবারিক আদালতে মামলা করেন। আদালত ৭, ১১ ও ১৪ ফেব্রুয়ারি মেয়েদের সঙ্গে এরিকোর সাক্ষাতের অনুমতি দিয়ে আদেশ দেন।
কিন্তু ইমরান আদালতের আদেশ ভঙ্গ করে মাত্র একবার মায়ের সঙ্গে দুই মেয়েকে সাক্ষাতের সুযোগ দেন। এরপর গত ৯ ফেব্রুয়ারি ‘মিথ্যা তথ্যের ভিত্তিতে’ ইমরান তার মেয়েদের জন্য নতুন পাসপোর্ট গ্রহণ করেন। ২১ ফেব্রুয়ারি জেসমিন মালিকা ও লাইলা লিনাকে নিয়ে তিনি দুবাই হয়ে বাংলাদেশে চলে আসেন।
গত ৩১ মে টোকিওর পারিবারিক আদালত জেসমিন মালিকা ও লাইলা লিনাকে তাদের মা এরিকোর জিম্মায় হস্তান্তরের আদেশ দেন। তবে দুই মেয়ে বাংলাদেশে থাকায় বিষয়টি নিয়ে তিনি বাংলাদেশের একজন মানবাধিকার কর্মী ও আইনজীবীর সঙ্গে পরামর্শ করেন। এরপর গত ১৮ জুলাই তিনি শ্রীলঙ্কা হয়ে বাংলাদেশে আসেন।
বাংলাদেশে এসে এরিকো করোনা পরীক্ষা করালে তার রিপোর্ট নেগেটিভ থাকার পরেও ইমরান ওই রিপোর্ট অবিশ্বাস করে সন্তানদের সঙ্গে তাকে সাক্ষাতে অস্বীকৃতি জানান। গত ২৭ জুলাই এরিকোর মোবাইল সংযোগ বন্ধ করে চোখ বাঁধা অবস্থায় মেয়েদের সঙ্গে সাক্ষাতের সুযোগ দেওয়া হয়। এ অবস্থায় দুই মেয়েকে নিজের জিম্মায় পেতে হাইকোর্টে রিট করেন জাপানি চিকিৎসক নাকানো এরিকো।
